Brendan Maslauskas Dunn said he met Mr. Towery in spring 2007, when Mr. Maslauskas Dunn became involved with Port Militarization Resistance, a group that has frequently tried to disrupt military shipments in Olympia, Tacoma and other ports nearby. Mr. Maslauskas Dunn, who was also active in at least one other group, Students for a Democratic Society, said Mr. Towery had identified himself as John Jacob, using his middle name as his last. He said he worked as a civilian at Fort Lewis doing computer support, Mr. Maslauskas Dunn said.
Mr. Towery, he said, frequently attended protests but had not been among those who agreed in advance that they would be willing to be arrested. He said Mr. Towery had often worked as a “watcher” who tracked law enforcement at the protests.

Yet he and Mr. Maslauskas Dunn, who said he worked as a janitor at a lumber mill in Shelton, Wash., said Mr. Towery’s identity was inadvertently discovered after a public records request made with the City of Olympia. The request yielded an e-mail message Mr. Towery had sent to another person with a military address relating to the protesters’ activities.
That led Mr. Hendricks and other group members to try to determine who Mr. Towery was. After they learned it was the man they had known as Mr. Jacob, they discussed it at City Council meeting in Olympia last week and posted the information on a Web site.

Anti-war activists in Olympia, Wash., have exposed Army spying and infiltration of their groups, as well as intelligence gathering by the Air Force, the federal Capitol Police and the Coast Guard. The infiltration appears to be in direct violation of the Posse Comitatus Act preventing U.S. military deployment for domestic law enforcement and may strengthen congressional demands for a full-scale investigation of U.S. intelligence activities, like the Church Committee hearings of the 1970s.

ECHELON Outed by Head of Australia's Defence Signals Directorate (1999)
Australia, one of five countries running the controversial Echelon global surveillance network, has become the first to admit it. The Australian government has confirmed that the system spies on the international communications of it own and other countries' citizens. As part of their disclosures, Australian intelligence officials have also published details of secret government orders which restrict spying on Australian citizens.
Besides requiring European countries to start dealing seriously with the threat of economic espionage through the Echelon system, the Australian disclosures should force other nations to review whether the protections for their citizens' privacy matches up to the Australian standards - if they exist at all.
In a series of letters to Australia's Channel Nine "Sunday" programme, revealed this week, the head of Australia's Defence Signals Directorate (DSD), Martin Brady, states that DSD "does co-operate with counterpart signals intelligence organisations overseas under the UKUSA relationship". The contents of the letters were disclosed after the Nine Network transmitted a one hour documentary on Echelon, last Sunday.
The UKUSA agreement binds together the giant US National Security Agency with the signals intelligence organisations of Britain, Canada, Australia and New Zealand. Although its precise terms have never been revealed, the UKUSA agreement provides for sharing facilities, staff, methods, tasks and product between participating governments.

Under the Echelon system, millions of messages are automatically intercepted every hour, and checked according to criteria supplied by intelligence agencies and governments in all five UKUSA countries. The intercepted signals are passed through a computer system called the Dictionary, which checks each new message or call against thousands of "collection" requirements. The Dictionaries then send the messages into the spy agencies' equivalent of the Internet, making them accessible all over the world.
Satellite control centre in the desert
DSD runs some of the world's most famous spying bases, including Pine Gap, an isolated satellite control centre near Alice Springs in the middle of the hot central Australian desert "outback". For more than 30 years, Pine Gap has controlled the CIA's electronic listening satellites, called Rhyolite, Aquacade and Magnum.
Australians have long suspected that the CIA-run station spied on their communications. The use and control of Pine Gap by the CIA was a central issue in the overthrow of radical labour Prime Minister Gough Whitlam in 1975. The Australian government now claims that after years of controversy, Australians are in charge. They also say that a former "American-only" communications centre on the base has been closed down, and that Australian staff now see everything the CIA satellites do.

Director Brady's decision to break ranks with the US and officially admit the existence of the hitherto officially unacknowledged spying organisation called UKUSA is likely to irritate his British and American counterparts, who have spent the last 50 years trying to prevent their own citizens from learning anything about them or their business of "signals intelligence" - "sigint" for short.
International and governmental concern about the UKUSA Echelon system has grown dramatically since 1996, when New Zealand writer Nicky Hager revealed intimate details of how it operated.
New Zealand runs an Echelon satellite interception site at Waihopai. A year after publishing his book, Hager and New Zealand TV reporter John Campbell mounted a daring raid on Waihopai, and sneaked inside the base, complete with a TV camera and a stepladder. From open, high windows, they then filmed into and inside its operations centre.
They were astonished to see that it operated completely automatically. Lights flashed on long racks of electronic equipment as messages were analysed and sent on. Rows of computer monitors sat unattended, as the codeword "Envoy" rotated round the screens.

Former Merry Prankster's Connection to Dan White's "Twinkie Defense"
J. I. Rodale, health food and publishing magnate, once claimed in an editorial in his magazine, Prevention, that Lee Harvey Oswald had been seen holding a Coca-Cola bottle only minutes after the assassination of President John F. Kennedy. He concluded that Oswald was not responsible for the killing because his brain was confused. He was a "sugar drunkard." Rodale, who died of a heart attack during a taping of The Dick Cavett Show -- in the midst of explaining how good nutrition guarantees a long life -- called for a full-scale investigation of crimes caused by sugar consumption.
In a surprise move, Dan White's defense team presented a similar bio-chemical explanation of his behavior, blaming it on compulsive gobbling down of sugar-filled junk-food snacks. This was a purely accidental attack. Dale Metcalf, a former member of Ken Kesey's Merry Pranksters who had become a lawyer, told me how he happened to be playing chess with Steven Scheer, an associate of Dan White's attorney.
Metcalf had just read Orthomolecular Nutrition by Abram Hoffer. He questioned Scherr about White's diet and learned that, while under stress, White would consume candy bars and soft drinka. Metcalf recommended the book to Scherr, suggesting the author as an expert witness. In his book, Hoffer revealed a personal vendetta against doughnuts, and White had once eaten five doughnuts in a row.
During the trial, one psychiatrist stated that, on the night before the murders, while White was "getting depressed about the fact he would not be reappointed [as supervisor], he just sat there in front of the TV set, bingeing on Twinkies." In my notebook, I immediately scribbled "the Twinkie defense," and wrote about it in my next report.
This was the first time that phrase had been used, and it was picked up by the mainstream media.
In court, White just sat there in a state of complete control bordering on catatonia, as he listened to an assembly line of psychiatrists tell the jury how out of control he had been. One even testified that, "If not for the aggravating fact of junk food, the homicides might not have taken place."

Ken Kesey, Allen Ginsberg, Jerry Garcia - CIA MK-ULTRA Medical Guinea Pigs
Ken Kesey, while a Wallace Stegner Fellow at Stanford University (1959-1961), offered himself as a human guinea pig in an MK-ULTRA subproject utilizing such psychedelics as LSD-25, psylocibin, and mescaline inside the walls of Menlo Park Veterans Hospital. It was via Ken Kesey, who disbursed smuggled quantities of then-legal LSD to his intellectual cohorts at Stanford's Perry Lane, that the psychedelic Sixties was born.

At Stanford in 1959, Kesey volunteered to take part in a CIA-financed study named Project MKULTRA at the Menlo Park Veterans Hospital. The project studied the effects of psychoactive drugs, particularly LSD, psilocybin, mescaline, cocaine, AMT, and DMT on people.[4] Kesey wrote many detailed accounts of his experiences with these drugs, both during the Project MKULTRA study and in the years of private experimentation that followed. Kesey's role as a medical guinea pig inspired him to write One Flew Over the Cuckoo's Nest in 1962. The success of this book, as well as the sale of his residence at Stanford, allowed him to move to La Honda, California, in the mountains south of San Francisco. He frequently entertained friends and many others with parties he called "Acid Tests" involving music (such as Kesey's favorite band, The Warlocks, later known as the Grateful Dead), black lights, fluorescent paint, strobes and other "psychedelic" effects, and, of course, LSD. These parties were noted in some of Allen Ginsberg's poems and are also described in Tom Wolfe's The Electric Kool-Aid Acid Test, as well as Hell's Angels: The Strange and Terrible Saga of the Outlaw Motorcycle Gangs by Hunter S. Thompson and Freewheelin Frank, Secretary of the Hell's Angels by Frank Reynolds. Ken Kesey was also said to have experimented with LSD with Ringo Starr in 1965 and in fact influenced the set up for their future performances in the UK.

There are those who would suggest that the Beat Movement was part of a grand conspiracy; and the Beats themselves unwitting pawns in this game. In one of his many broadsheets self-published over the years, Kerry Thornley once posited this theory, without actually elaborating on exactly what this conspiracy entailed. Perhaps what Thornley was alluding to is the same theme found in Todd Brendan Fahey's Wisdom's Maw, which suggests that Ken Kesey as well as the Beats were part of an elaborate scheme concocted by the American Intelligence Community to infiltrate and supply the sixties counterculture with mind altering drugs, ostensibly to test their reactions, and--long range--to influence widespread social control. Theoretically, this was all conducted under the covert auspices of such infamous CIA mind control projects as Artichoke and MK-ULTRA. Such countercultural icons as Kesey and Leary--Fahey suggests--were chosen by the CIA and Military Intelligence as facilitators of this grand experiment, whose powerful side effects are still lingering to this day in the collective craniums of its unwitting participants.

Ginsberg first became acquainted with LSD in 1959, through government sponsored research at the Menlo Research Institute in Palo Alto. Kesey and Jerry Garcia were also early volunteers for these mind-bending experiments, which many connect directly to MK-ULTRA. This before the term psychedelic was in the popular lexicon. At this time psychedelics were referred to as 'psychomimetic' drugs; drugs that reportedly brought about temporary psychosis. Kesey and the other adventurous souls who volunteered their brains for science received 75 dollars a day. Due to a bad trip courtesy of the Menlo Research Institute, Ginsberg composed a poem under the influence of LSD, aptly titled, "Lysergic Acid" of which the following is an excerpt: It is a multiple million eyed monster it is hidden in all it's elephants and selves it hummeth in the electric typewriter it is electricity connected to itself, if it hath wires it is a vast Spiderweb... I, as well, have beheld this multiple million eyed monster, hidden--as it is--in all elephants and selves. Like Ginsberg, acid brought about this nightmarish vision, on the full-size Technicolor viewing screen behind my closed eyelids. Whether or not this monstrous, Bosch-like archetype is inherent exclusively to practitioners of Guerrilla Khundalini, I can not authoritatively address. Nevertheless, I find it interesting that Ginsberg's description of this demonic entity--viewed under the influence of lysergic acid diethylamide--matches almost perfectly my own temporary psychedelic psychosis, producing what would appear to be a shared thematic experience linking the drug experimentation of the Beat subculture with my own generation of Guerrilla Khundalini adepts, forming--one might conjecture--a metaphysical conspiracy that bridges generations; that of a religion of elitists waving no particular banner (except maybe, a "freak flag"), dedicated to the principle of discovering "GOD" on their own terms, without benefit of a mediating agency, or dogmatic agenda. Robert Anton Wilson summed it up best in his intro to Cosmic Trigger when categorizing this new age of holy mad men:
"We are all evolving into the use of new neurological circuits, which will make us superhuman in comparison to our present average state. The activation of these new circuits creates a great deal of temporary weirdness until we learn to use them properly..."

The way they’ve sort of contorted the new amendments to the act, it’s hard to tell what’s legal and what isn’t, because they’ve taken the Foreign Intelligence Surveillance Court largely out of the mix. And so, much of what is being done is governed by secret rules known as USSID 18, United States Signals Intelligence Directive 18, which is above top-secret. It’s top-secret code words. So what is legal, what isn’t legal, it’s very hard to tell.
And I think that’s why you really need a congressional committee to really take a look at this. What really needs to happen is a very in-depth examination of NSA post/11—actually, pre-9/11 and post-9/11, the kind that was done in the mid-1970s by Senator Frank Church, the Church Committee. I think that’s really the only way to get to the bottom of whether NSA messed up before the attacks on 9/11 and whether they’re doing things that are illegal or improper after 9/11.

Immediately following the Second World War, in 1947, the governments of the United States, the United Kingdom, Canada, Australia and New Zealand signed a National Security pact known as the ‘Quadripartite’ or ‘United Kingdom-United States’ (UKUSA) Agreement. Its intention was to seal an intelligence bond in which a common national security objective was created. Under the terms of the agreement, the five nations carved up the earth into five spheres of influence, and each country was assigned particular signals intelligence (SIGINT) targets.
The UKUSA Agreement standardised terminology, code words, intercept handling procedures, arrangements for co-operation, sharing of information, Sensitive Compartmented Information (SCI) clearances and access to facilities. One important component of the agreement was the exchange of data and personnel.
The strongest alliance within the UKUSA relationship is the one between the US National Security Agency (NSA), and Britain’s Government Communi-cations Headquarters (GCHQ). The NSA operates under a 1952 presidential mandate, National Security Council Intelligence Directive (NSCID) Number 6, to eavesdrop on the world’s communications networks for intelligence and military purposes. In doing so, it has built a vast spying operation that can reach into the telecommunications systems of every country on earth. Its operations are so secret that this activity, outside the US, occurs without any legislative or judicial oversight. The most important facility in the alliance is Menwith Hill, an Air Force base in the north of England. With over two dozen radomes and a vast computer operations facility, the base has the capacity to eavesdrop on vast chunks of the communications spectrum. With the creation of Intelsat and digital telecommunications, Menwith Hill and other stations developed the capability to eavesdrop on an extensive scale on fax, telex and voice messages.

In June 1999, the US House of Representatives Permanent Select Committee on Intelligence ordered the NSA to hand over documents relating to Echelon. The NSA, for the first time in the Committee’s history, refused to do so, claiming attorney/client privilege.[6] In May 1999, Representative Bob Barr, worried by the potential breach of constitutional privacy rights, introduced an amendment to the Fiscal 2000 Intelligence Authorization Act requiring the Director of Central Intelligence, the director of NSA and the Attorney General to submit a report outlining the legal standards being employed within project Echelon to safeguard the privacy of American citizens.

The NSA and Domestic Espionage (Part Four)
No Such Agency
The following is from a great site, which contains extensive excerpts from books and additional information from other media sources referencing the UKUSA agreement, ECHELON, the NSA and domestic espionage. Some of the information is review from previous posts on this subject:
Attorney John Loftus is the author of four histories of intelligence operations. As a former prosecutor with the U.S. Justice Department's Nazi-hunting unit, he had unprecedented access to top-secret CIA and NATO archives. Mark Aarons is an investigative reporter and author of several books on intelligence related issues.
One day I was flipping channels, and came across "The Leon Charney Show". Attorney Charney was interviewing Attorney Loftus, who has many many connections in the intelligence world.
Mr. Loftus described a room in NSA's Fort Meade that was actually British soil (diplomatic territory), with a British guard posted outside...
In 1943 this resulted in the Britain-USA (BRUSA) agreement to merge the Communications Intelligence (COMINT) agencies of both governments.
One of the little-known features of BRUSA was that President Roosevelt agreed that the two governments could spy on each others' citizens, without search warrants, by establishing "listening posts" on each others' territory.
According to several of the "old spies" who worked in Communications Intelligence, the NSA headquarters is also the chief British espionage base in the United States. The presence of British wiretappers at the keyboards of American eavesdropping computers is a closely guarded secret, one that very few people in the intelligence community have been aware of, but it is true.
An American historian, David Kahn, first stumbled onto a corner of the British connection in 1966, while writing his book The Codebreakers. One indication of just how sensitive this information is considered on both sides of the Atlantic is the fact that Kahn's publishers in New York and London were put under enormous pressure to censor a great deal of the book. In the main, Kahn simply revealed the existence of the liaison relationship, but when he wrote that the NSA and its British equivalent, the Government Communications Headquarters, "exchange personnel on a temporary basis", he had come too close to revealing the truth.
The U.S. government told Kahn to hide the existence of British electronic spies from the American public. Kahn eventually agreed to delete a few of the most sensitive paragraphs describing the exchange of codes, techniques, and personnel with the British government.
His innocuous few sentences threatened to disclose a larger truth. By the 1960s the "temporary" British personnel at Fort Meade had become a permanent fixture. The British enjoyed continued access to the greatest listening post in the world.
The NSA is a giant vacuum cleaner. It sucks in every form of electronic communication. from telephone calls to telegrams, across the United States. The presence of British personnel is essential for the American wiretappers to claim plausible deniability.
Here is how the game is played. The British liaison officer at Fort Meade types the target list of "suspects" into the American computer. The NSA sorts through its wiretaps and gives the British officer the recording of any American citizen he wants. Since it is technically a *British* target of surveillance, no *American* search warrant is necessary. The British officer then simply hands the results over to his American liaison officer.
Of course, the Americans provide the same service to the British in return. All international and domestic telephone calls in Great Britain are run through the NSA's station in the British Government Communications Headquarters (GCHQ) at Menwith Hill, which allows the American liaison officer to spy on any British citizen without a warrant.
According to our sources, this duplicitous, reciprocal arrangement disguises the most massive, and illegal, domestic espionage apparatus in the world. Not even the Soviets could touch the U.K.-U.S. intercept
technology.
Through this charade, the intelligence services of each country can claim they are not targeting their own citizens. This targeting is done by an authorized foreign agent, the intelligence liaison resident in Britain or the United States.
Thus, in 1977, during an investigation by the House Government Operations Committee, Admiral Inman could claim, with a straight face, that "there are no U.S. Citizens now targeted by the NSA in the United
States or abroad, none."
Since the targeting was done not by NSA but by employees of British GCHQ, he was literally telling the truth. According to a former special agent of the FBI, the you-spy-on-mine, I'll-spy-on-yours deal has been extended to other Western partners, particularly Canada and Australia. The British, with the help of sophisticated NSA computers, can bug just about anyone anywhere. The electronic search for subversives continues, particularly in the U.S.
The NSA conceded precisely that point when the U.S. Justice Department investigated its wiretapping of American protesters during the Vietnam. The NSA assured the Justice Department that the information was acquired only *incidentally* as part of a British GCHQ collection program.
The "incidental" British exception has become the rule. To this day Congress does not realize that the British liaison officers at the NSA are still free to use American equipment to spy on American citizens. And, in fact, they are doing just that. Congress has been kept in the dark deliberately. This is a fact, not a matter of conjecture or a conclusion based on anonymous sources.
In the early 1980s, during the Reagan administration, one of the authors of this book submitted to the intelligence community a draft of a manuscript that briefly described the wiretap shell game and mentioned the secrecy provisions concerning British liaison relationships with the NSA have escaped congressional knowledge. The result was an uproar. The intelligence community insisted that all passages explaining the British wiretap program had to be censored and provided a list of specific deletions.

David Kahn, in a transatlantic phone call, reluctantly agreed to delete a handful of paragraphs dealing with the most sensitive subject of all: NSA's relationship with its supersecret British partner, GCHQ. "The two agencies exchange personnel on a temporary basis... A similar but much smaller liaison program is maintained with Canada and Australia."
After two years of compromising and negotiating, the BRUSA Agreement was supplemented in 1947 by the five-power UKUSA Agreement, which, according to one report, established the United States as a first party to the treaty, and Britain, Canada, and Australia-New Zealand as second parties.
...quite likely the most secret agreement ever entered into by the English-speaking world. Signed in 1947 and known as the UKUSA Agreement, it brought together under a single umbrella the SIGINT organizations of the United States, Britain, Canada, Australia and New Zealand. The UKUSA Agreement's existence has never been officially acknowledged by any country even today.
Sharing seats alongside the NSA operators, at least in some areas, are SIGINT specialists from Britain's Government Communications Headquarters (GCHQ). According to a former Menwith Hill official, the two groups work very closely together.
David Watters, a telecommunications engineer once attached to the CIA's communications research and development branch, pulls out a microwave routing map of the greater Washington area and jabs his index finger at a small circle with several lines entering it and the letters NSA. "There's your smoking pistol right here." Watters says it is tied into the local telephone company circuits, which are interconnected with the national microwave telephone system owned by AT&T. Other specialists testified to the same thing: purely domestic intercepts.
"Technical know-how" for microwave communications intercept was aided by William Baker, head of AT&T's Bell Laboratories and at the same time an important member of the very secret NSA Scientific Advisory Board. After all, it was Bell Labs under Baker that, to a great extent, developed and perfected the very system that the NSA hoped to penetrate.

For the last three decades the NSA has been a frequent and secret participant in regulatory matters before the Federal Communications Commission, where important decisions are made that directly affect the structure of the telephone company, the use of radio airwaves and the operation of communication satellites.]
1962. Now, for the first time, NSA had begun turning its massive ear inward toward its own citizens. With no laws or legislative charter to block its path, the ear continued to turn.
The Secret Service, the CIA, the FBI and the DIA submitted entries for the NSA's watch list.
The names on the various watch lists ranged from members of radical political groups to celebrities to ordinary citizens involved in protest against their government.
Included were such well-known figures as Jane Fonda, Joan Baez, Dr. Benjamin Spock, Dr. Martin Luther King Jr., the Reverand Ralph Abernathy, Black Panther leader Eldridge Cleaver, and Chicago Seven defendants Abbie Hoffman and David T. Dellinger.
A frightening side effect of the watch list program was the tendency of most lists to grow, expanding far beyond their original intent. This multiplier effect was caused by the inclusion of names of people who came in contact with those persons and organizations already on the lists.
Because of the NSA's vacuum cleaner approach to intelligence collection ---whereby it sucks into its system the maximum amount of telecommunications and then filters it through an enormous screen of "trigger words" --- analysts end up reviewing telephone calls, telegrams, and telex messages to and from thousands of innocent persons having little or nothing to do with the actual focus of the effort. And when a person made the watch list, any conversations EVEN MENTIONING that person are scooped up.
By now, the names of U.S. citizens on NSA's many watch lists for fighting the drug war had grown from the hundreds into the thousands.
Even when Noel Gayler took over as Director of the NSA in August 1969, NSA personnel waited a year or so before briefing even him on the NSA watch list program.
NSA Director General Allen testified to Congress that there is no statute that prevents the NSA from interception of domestic communications. Asked whether he was concerned about the legality of expanding greatly its targeting of American citizens, the NSA replied: "Legality? That particular aspect didn't enter into the discussions."
Innocent Americans - people neither targeted nor watch-listed - are scooped up into the NSA's giant vacuum cleaner. This happens with considerable frequency because of the way in which names and phrases are jam-packed into the computers. Even though NSA's specialized supercomputers have enormous storage capacities, the tremendous number of targets forces the Agency to squeeze the watch lists together as tightly as possible.
Its power to eavesdrop, the NSA had always insisted, came under no earthly laws but rather emanated from some celestial "inherent presidential authority" reposed in the chief executive by the Constitution.
Senator Edward M. Kennedy tried year after year to pass legislation to require the NSA to submit to judicial review.
Finally, the Foreign Intelligence Surveillance Act [FISA] was signed into law by president Carter on October 25, 1978. The key to the legislation could only have been dreamed up by Franz Kafka: the establishment of a supersecret federal court.
The legislation established a complex authorization procedure and added a strict "minimization" requirement to prohibit the use and distribution of communications involving Americans inadvertently picked up during the intercept operations.
These requirements constitute the most important parts of the FISA law, and were included to prevent the watch-listing of American citizens, which took place during the 1960s and 1970s. The Supreme Court Chief Justice picks which federal judges serve in the Star Chamber.
The FISA court judge rules that black-bag jobs of "nonresidential premises under the direction or control of a foreign power" need no court approval. The FISA legislation also exempts from judicial review communications of these sites, including embassies. A final judicial review exception authorized the Agency to distribute the communication if it relates to criminal activity.
Within the United States, FISA still leaves the NSA free to pull into its massive vacuum cleaner every telephone call and message entering, leaving, OR TRANSITING the country.
By carefully inserting the words "by the National Security Agency" into the FISA legislation, the NSA has skillfully excluded from the coverage of the FISA statute as well as the surveillance court all interceptions received from the British GCHQ or any other non-NSA source. Thus it is possible for GCHQ to monitor the necessary domestic circuits and pass them on to the NSA through the UKUSA Agreement, giving them impunity to target and watch-list Americans.
Three decades after its creation, the NSA is still without a formal charter. Instead, there is a super hush-hush surveillance court that is virtually impotent; the FISA, which has enough loopholes and exceptions to render it nearly useless; and an executive order that was designed more to protect the intelligence community from citizens than citizens from the agencies. In addition, because it is an executive order, it can be changed at any time at the whim of a President, without so much as a nod toward Congress.
On January 24, 1978, President Jimmy Carter issued an executive order imposing detailed restrictions on the nation's intelligence community. The order was designed to prevent the long list of abuses of the 1960s and 1970s. But four years later President Ronald Reagan scrapped the Carter order and broadened considerably the power of the spy agencies to operate domestically.
Under the Reagan executive order, the NSA can now, apparently, be authorized to lend its full support - analysts as well as computers - to "any department or agency" in the federal government and, "when lives are endangered," even to local police departments.
Like an ever-widening sinkhole, the NSA's surveillance technology will continue to expand, quietly pulling in more and more communications and gradually eliminating more and more privacy. If there are defenses to such technotyranny, it would appear, at least from past experience, that they will not come from Congress. Rather, they will most likely come from academe and industry in the form of secure cryptographic applications to private and commercial telecommunications equipment. The same technology that is used against free speech can be used to protect it, for without protection the future may be grim.
Senator Frank Church, chairman of the Senate Intelligence committee, referring to the NSA's SIGINT technology:
At the same time, that capability at any time could be turned around on the American people and no American would have any privacy left, such is the capability to monitor everything: telephone conversations, telegrams, it doesn't matter.
There would be no place to hide. If the government ever became a tyranny, if a dictator ever took charge in this country, the technological capacity that the intelligence community has given the government could enable it to impose total tyranny and there would be no way to fight back, because the most careful effort to combine together in resistance to the government, no matter how privately it was done, is within the reach of the government to know.
Such is the capability of this technology...
I don't want to see this country ever go across the bridge. I know the capacity that is there to make tyranny total in America, and we must see to it that this agency and all agencies that possess this technology operate within the law and under proper supervision, so that we never cross over that abyss.
That is the abyss from which there is no return.

So what you are saying is if each official then GIVES, as quid pro quo, their reports to the other side, that's legal?
According to James Bamford (a NSA and intelligence expert) [Update: Dec24.2005. It has yet to be conclusively determined whether or not Bamford actually comes out and clearly exposes the UKUSA agreement in regards to reciprocal domestic espionage as Loftus explicitly does in Secret War. It appears Bamford is merely hinting at and dancing around the issue in Body of Secrets due to access agreements with NSA ?] and John Loftus (a former Justice Department prosecutor and intelligence expert), it is legal. The reports could also, for example, be anonymously mailed to a US liaison officer by the Britsh ? Who's to know where they came from if they appeared in a mail box or drop box somewhere ?
I assume that we would not use the Brits to spy on someone domestically when time is of the essence...

No judge's decision is needed. Since it is technically a British operation, FISA does not apply to foreign intelligence agencies. And besides, what are friends for ? All of the Presidents have been allowing this since at least the 1960's. Even Clinton. For Hegel to say, "Every president, that we know of, has complied with the law (FISA), is technically correct. The operative phrase in this case is "...that we know of..." The cover story is that Congress does not know about the British officers working at NSA as a result of the UKUSA surveillance agreement.

Indeed, it couldn't be any clearer that the FISA provisions are not to be used against US citizens, and if they ever were, then the information gathered could not be retained or used.
Sections 215 and 218 of the USAPATRIOT Act supersede this FISA provision:
Section 215: The government can use these warrants for the "production of any tangible things."
Section 218: With section 218 Ashcroft picked another lock restraining the dragon of central government power, in this case superintrusive bugs, taps and black bag jobs. He changed FISA's provision that the operation's "primary purpose" be to fight foreign intelligence or terrorism to require that one of these be merely "a purpose." Similarly, as Loftus also writes (Pg 191, Secret War) ...the information was acquired only "incidentally" [...] as part of the collection program.

The New York Times is reporting the espionage program monitored communications that were entirely domestic -- despite recent assurances from top administration officials that one end of the intercepted communications came from abroad. Government officials told the Times the intercepts were “accidental.”
Or..."incidental..." rather than "accidental" (see Loftus above) "incidental" intercepts are legal under Section 218 of the USAPATRIOT Act and FISA as they are "a purpose" of a foreign intelligence or terrorism surveillance and collections program. Once Pandora's cookie jar is opened, all the cookies in the jar are fair game.
Earlier this week, former NSA director Gen. Michael V. Hayden, currently the second-ranking intelligence official in the country, told reporters: "I can assure you, by the physics of the intercept, by how we actually conduct our activities, that one end of these communications are always outside the United States."
Attorney General Alberto R. Gonzales made the same claim: "People are running around saying that the United States is somehow spying on American citizens calling their neighbors. [Its] very, very important
to understand that one party to the communication has to be outside the United States."

The NSA and Domestic Espionage (Part One)
The real story behind the UKUSA agreement and NSA domestic espionage from former Justice Department prosecutor John Loftus. No FISA court warrants required:
By the 1960’s the “temporary” British personnel at Fort Meade had become a permanent fixture. The British enjoyed continued access to the greatest listening post in the world. The NSA is a giant vacuum cleaner. It sucks every form of electronic information, from telephone calls to telegrams, across the United States. The presence of British personnel is essential for the American wiretappers to claim plausible deniability.
Here is how the game is played. The British liaison officer at Fort Meade types the target list of “suspects” into the American computer. The NSA computer sorts through its wiretaps and gives the British officer the recording of any American citizen he wants. Since it is technically a British target of surveillance, no American search warrant is necessary. The British officer then simply hands the results over to his American liaison officer.
Of course, the Americans provide the same service to the British in return. All international and domestic telephone calls in Great Britain are run through the NSA’s station in the British Government Communications Headquarters (GCHQ) at Menwith Hill, which allows the American liason officer to spy on any British citizen without a warrant. According to our sources, this duplicitous, reciprocal arrangement disguises the most massive and illegal, domestic espionage apparatus in the world. Not even the Soviets could touch the UK-US intercept technology.
Through this charade, the intelligence services of each country can claim that they are not targeting their own citizens. The targeting is done by an authorized foreign agent, the intelligence liaison resident in Britain or the United States. Thus, in 1977, during an investigation by the House Government Operations Committee, Admiral Inman could claim, with a straight face, that “there are no US citizens now targeted by the NSA in the United States or abroad, none.” Since the targeting was done not by NSA but by employees of British GCHQ, he was telling the literal truth. Still, the congressional staff knew enough at the time to characterize Inman’s statements in an unpublished report as “misleading.”

The implication is Americans obviously don't know how to read or handle the truth about their government's perpetual lying machine.
